By registering, enrolling or paying for an online course, you are agreeing to the terms and conditions below:

Registration

Students must provide accurate and up-to-date information when registering for a course or courses. Failure to provide accurate and up-to-date information will be a breach of contract and may result in the termination of your registration and forfeiture of fees. You certify that you are the person that enrolled for the course or courses and you are the only person that has participated in the online course or taken any quizzes or exams.

Requirements for Completing Courses

Please refer to the directions on your course home page for specific instructions regarding the completion of your course and the "Introduction Lesson" at the beginning of each course. Students must complete the following to complete a course:

  • Complete all of the course material.
  • Complete the chapter quizzes.
  • Complete a short student survey.
  • Successfully complete the end of course exam with a score of 70% or better.

TREC requires the final exam to be a proctored exam. Texas State Online Real Estate will, at it's option, provide the student with either of two (2) options:

Option 1: Students must take the final exam at a location with a live proctor. In most cases this will be a school or university in the local area close to the student. Instructions will be provided by the proctor before beginning the final exam so students understand the requirements.

Option 2: Utilize proctor software installed on the students computer. This option requires that students have a computer with a video camera and install the required software on their computer. Instructions will be provided by the proctor before beginning the final exam so students understand the requirements.

For any course that requires a proctored final exam, there will be a $50.00 fee for final exam retakes.

Course Expiration

The original enrollment period is 6 months for each course beginning on the day of enrollment. Students must complete the courses and any associated exams for the course within 180 days from the date of enrollment.

Course Extensions

Students may request course extensions. For a $25.00 fee, a course can be extended for one (1) month from the date of expiration. Courses can be extended a maximum of 6 times for a total of 6 months. There are no refunds for course extensions, because the student is already familiar with the courses.

Certificate of Completion

Upon completion of a Pre-Licensing course or SAE course, you will receive a Certificate of Completion for each course that must be submitted with your application to TREC. The certificate of completions are sent by email in the form of a pdf file. Certificates will be issued within 5 to 7 days of completion of the course.

Cancellation, Rebates and Refunds

A refund can be requested in writing by email up to 10 calendar days from the date of purchase for a course that has not been completed. This 10 day time period is referred to as a No Risk 10 Day Trial. A student that notifies Texas State Online Real Estate LLC in writing by email requesting a refund during the No Risk 10 Day Trial will receive a full refund with no questions asked. There are no refunds after 10 days and, if any courses were completed during the 10 day trial period, there are no refunds for completed courses. If the refund is for a package of courses and the student has completed 1 or more of the courses, the completed courses will be charged at the full price for the individual courses instead of the discounted package price.

A student that notifies Texas State Online Real Estate LLC requesting a Military Rebate in writing by email within 10 calendar days of the course enrollment date and submits proof of military status will receive a rebate. There are no rebates after 10 days.

Warranty

This service is provided for your use only and we make no warranty of any kind, implied or express, including without limitation, fitness for particular purpose, except that the courses have been approved by the Texas Real Estate Commission. We do not endorse, warrant or guarantee any product or service offered through our service. We are not a party to any third party transactions. We do not warrant the accuracy or completeness of material available on or through our service. Although reasonable efforts will be made, there is no warranty that the Texas State Online Real Estate website will be free from infection by computer viruses or any other malicious or destructive programs.

Limited Liability

Our maximum liability and your exclusive remedy is renewed online access to defective online courses or the replacement of defective goods purchased from Texas State Online Real Estate. We will not be liable for any loss or injury from our service including, but not limited to, compensatory damages, lost profits, lost data, or any form of incidental indirect, consequential or punitive damages or any kind whatsoever, whether or not caused in whole or in part by our negligence or by contingencies beyond our control. Neither we nor our suppliers are responsible or liable, directly or indirectly, for any loss or damage caused by the use or reliance on or inability to use or access any of our services, content or information.

Indemnification

You agree to indemnify us and hold us, our employees, agents, officers, directors, contractors, suppliers, and other representatives harmless from and against all liabilities, damages, claims, actions, costs and expenses including attorney fees, for any reason whatsoever, in connection with or arising from your use of the services provided by us.

Governing Law

The laws of the State of Texas govern this agreement, your subscription and use of the services. You agree that the courts of the State of Texas have exclusive jurisdiction for any claim, action or dispute under this agreement and that the venue shall be Harris County.
